General Terms of service

Introduction

Welcome to xHosts UK. xHosts UK is operated as a sole trader business. Throughout these terms and conditions, we may refer to ourselves as "xHosts", "xHosts UK", or "the Provider". The customer may be referred to as "you", "the customer", or "the client". By accessing our website, placing an order, or utilizing our services, you agree to comply with the terms and conditions outlined below.

We reserve the right to modify, update, or change these terms at any time without prior notice. Continued use of our website or services after any such changes shall constitute your acceptance of the updated terms.

xHosts utilizes FraudRecord to screen new orders for fraudulent activity and to report existing clients who violate our Terms of Service. In the event of a violation, your information may be reported to FraudRecord in a non-identifying, anonymized form.

Data Loss & Protection

xHosts UK is not responsible for data backup or protection. While we may offer backup services as part of certain packages, we cannot guarantee the usability, availability, or reliability of any backups. Customers are solely responsible for maintaining regular and verified offsite backups of all data, files, emails, databases, and configurations. We will not be liable for any data loss, corruption, deletion, or interruption resulting from the use of our services.

Prohibited Uses (VPS / Virtual Servers)

Our services must not be used for any illegal activities under UK law or the laws applicable to the location of the service, the customer, or the targeted systems. Additionally, the following activities are strictly prohibited:

  • Cryptocurrency mining, including but not limited to Bitcoin, GPU, CPU, and CHIA mining.
  • Hosting phishing websites or phishing-related content.
  • Conducting, assisting, or facilitating (D)DoS attacks.
  • Operating botnet command and control servers.
  • IP address spoofing or packet forgery.
  • Sending unsolicited emails (spam) or distributing malware, ransomware, or malicious code.
  • Performing unauthorized port scanning, vulnerability scanning, or mass scanning activity (including zmap).
  • Engaging in torrent activities where they cause abuse complaints, legal issues, or excessive resource usage.
  • Hosting public/shared VPN or proxy services (private VPN servers are allowed, subject to fair use and abuse policies).
  • Using, storing, distributing, or facilitating cracked, pirated, or unlicensed software.
  • Hosting content that incites violence, hatred, or harm based on ethnicity, religion, nationality, disability, gender, or sexual orientation.
  • Creating tunnels to external data centers for the purpose of providing DDoS protection or mitigation without written permission.
  • Offering, advertising, or operating services on dark web or blackhat forums/websites.
  • Any activity that generates excessive abuse reports, blacklist listings, or legal complaints.

Violations of these policies, or being flagged on platforms such as (but not limited to) Spamhaus, may result in immediate suspension, termination, and/or a penalty of £25 per violation.

Service Suspension

We may suspend services for the following reasons:

  • Service abuse, including spam, phishing, malware, fraud, or illegal activity.
  • Exceeding bandwidth limits or causing excessive resource usage.
  • Security concerns, including compromised accounts or insecure configurations.
  • Detection of malware, abusive processes, or malicious traffic.
  • Listing of assigned IP addresses on security blacklists.
  • Service usage negatively impacting other customers or our infrastructure.
  • Activities posing a risk to our network, upstream providers, staff, reputation, or public safety.
  • Abusive, threatening, or harassing behaviour towards our staff.
  • Failure to respond to abuse or security reports within a reasonable time.

Fair Use Policy

Our Fair Use Policy is designed to ensure that all customers receive reliable service. While we do not impose hard bandwidth limits in all cases, we recommend an advisory usage of 50TB per month for virtual private servers (VPS), with bandwidth resetting on the 1st of each month.

Customers may monitor their usage via our VPS control panel at https://cp.xhosts.uk:4083 or via the client portal at https://my.xhosts.uk.

For UK dedicated servers, we provide unmetered bandwidth on a dedicated port. While there is an advisory limit of 75TB per month, restrictions may be imposed if usage disrupts other customers, negatively impacts network performance, creates excessive abuse complaints, or violates our policies or applicable law.

Payments & Billing

  • Invoices are issued 14 days before the renewal date unless otherwise stated.
  • Payments must be made on time to avoid service suspension.
  • A 10% late fee may be applied to overdue invoices.
  • Services may be suspended for non-payment.
  • If an invoice remains unpaid for seven (7) days, the associated service may be deleted and data may not be recoverable.
  • If a backup is available and a customer requests restoration, a £25 restoration fee may apply.
  • It is the customer's responsibility to ensure valid payment methods and current billing information are maintained.

Service Cancellation Period Before Renewal

  • VPS Servers: 72 hours (3 days)
  • Web Hosting: 24 hours (1 day)
  • Domain Names: 30 days
  • Bot Hosting: 24 hours (1 day)
  • Dedicated Servers: 14 days

Failure to provide cancellation notice within the required timeframe may result in the next renewal invoice remaining due.

By placing an order with xHosts UK, you confirm that you have read, understood, and agreed to this policy in full.

Service Deployment & Order Processing

  • Deployment timeframes are outlined on our service pages but may be subject to delays due to fraud, security, or manual reviews.
  • Orders requiring manual review will be processed during UK business hours (Monday to Friday, 9 AM – 5 PM, excluding public holidays).
  • We may request additional identification, documentation, or information to verify an order.
  • Orders placed using VPNs, proxies, mismatched billing details, or suspicious information may be rejected.
  • Customers must ensure that their account information remains accurate and up to date. Failure to provide legitimate information may result in service suspension or termination without prior notice.
  • We reserve the right to refuse, cancel, or limit any order at our sole discretion.

Payment Disputes

  • If a payment dispute arises (e.g. PayPal dispute, chargeback, or card reversal), all associated services may be suspended immediately until the dispute is resolved.
  • We reserve the right to report disputed payments to online fraud prevention databases.
  • A £75 administrative fee may apply for payment disputes.
  • Any unpaid balance, including dispute fees, administrative costs, and additional legal or collection costs, must be settled within 14 days. Failure to do so may result in further recovery action.

Service-Specific Terms

Additional service-specific terms may apply depending on the product or service purchased. These may include, but are not limited to, hosting services, virtual servers, dedicated servers, domain names, managed services, and one-time fee products. Where such additional terms apply, they form part of these Terms of Service.

Identity Verification & Abuse Prevention

To protect our network, upstream providers, platform integrity, and customers, xHosts UK reserves the right to request identity verification or additional information at any time, including after service activation.

Identity verification may be required in response to suspected abuse, fraud, policy violations, security concerns, elevated risk indicators, or increased abuse trends affecting specific services or product lines, including one-time fee hosting accounts.

Identity verification may be conducted through a trusted third-party provider, including Stripe Identity. xHosts UK does not receive, store, or process identity documents directly and only receives verification status and reference identifiers.

Failure or refusal to complete requested verification within a reasonable timeframe may result in service suspension or termination, without refund, in accordance with these Terms of Service.

Limitation of Liability

xHosts UK provides services on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

xHosts UK shall not be liable for any indirect, incidental, special, consequential, or economic loss, including but not limited to loss of profits, revenue, business, data, goodwill, or opportunity arising from the use of, inability to use, or interruption of our services, even if we have been advised of the possibility of such losses.

In all cases, our total liability shall not exceed the amount paid by the customer for the affected service during the three (3) months immediately preceding the event giving rise to the claim.

Network & Infrastructure

We reserve the right to suspend, restrict, reroute, null-route, filter, or terminate any service or traffic where required to protect our network, upstream providers, other customers, or infrastructure. This includes action taken in response to abuse complaints, DDoS attacks, security threats, excessive resource usage, legal requests, or emergency maintenance.

We do not guarantee uninterrupted service, continuous availability, or immunity from attacks, outages, hardware failure, third-party issues, upstream provider incidents, routing problems, or force majeure events.

Customer Responsibility

Customers are responsible for maintaining the security of their services, software, passwords, applications, and stored data. This includes keeping systems up to date, using strong passwords, securing control panels, and promptly responding to any abuse or security notices sent by us.

The customer is responsible for all activity conducted through their account or services, whether authorized by them or not, unless caused solely by our proven negligence.

Domain Names

Domain name services are subject to availability, registry rules, and registrar policies. Domain registrations, transfers, renewals, and restorations are generally non-refundable once processed. It is the customer's responsibility to ensure domain names are renewed before expiry where renewal is desired.

Termination

We reserve the right to suspend or terminate any service, without prior notice, where we reasonably believe there has been a breach of these Terms of Service, non-payment, abuse, unlawful activity, fraud, or conduct that places our systems, providers, customers, or reputation at risk.

Upon termination, access to the affected service may be removed immediately and stored data may be deleted without further notice.

Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes arising from or relating to these terms or our services shall be subject to the jurisdiction of the courts of England and Wales.
