</p>
<h3>Service Suspension</h3>
<p>We may suspend services for the following reasons:</p>
<ul>
<li>Service abuse, including spam, phishing, malware, fraud, or illegal activity.</li>
<li>Exceeding the bandwidth allowance stated for the service, where a bandwidth limit applies, or causing excessive resource usage.</li>
<li>Security concerns, including compromised accounts or insecure configurations.</li>

<li>Abusive, threatening, or harassing behaviour towards our staff.</li>
<li>Failure to respond to abuse or security reports within a reasonable time.</li>
</ul>
<h2>Bandwidth & Fair Use Policy</h2>
<p>
Bandwidth allowances for VPS, virtual server, and dedicated server services are determined by the specific
package or plan purchased. The amount of bandwidth included with a service will be stated on the applicable
product, package, order, or service description.
</p>
<p>
Where a VPS, virtual server, or dedicated server service is advertised as <strong>"Unmetered"</strong>,
no fixed monthly bandwidth or data transfer limit will apply.
</p>
<p>
Where a service is not advertised as <strong>"Unmetered"</strong>, the service is subject to the bandwidth
allowance stated for that specific package or service.
</p>
<p>
Where a bandwidth allowance applies, bandwidth usage will reset monthly on the
<strong>anniversary date of the service's original activation</strong>. For example, if a service was originally
activated on the 15th of the month, its bandwidth allowance will reset on the 15th of each subsequent month.
</p>
<p>
Customers may monitor their usage via the applicable service control panel or via the client portal at
<strong>https://my.xhosts.uk</strong>. VPS customers may also monitor usage through the VPS control panel at
<strong>https://cp.xhosts.uk:4083</strong>.
</p>
<p>
Unmetered bandwidth means that no fixed bandwidth or data transfer allowance is imposed on the service.
Unmetered services remain subject to the port speed and network connectivity provided with the purchased
service, as well as all other provisions of these Terms of Service.
</p>
<p>
Regardless of whether a service has a stated bandwidth allowance or is advertised as Unmetered, all services
remain subject to these Terms of Service, including our network, security, abuse, and prohibited-use policies.
We reserve the right to take reasonable action where traffic disrupts our network, negatively impacts other
customers or infrastructure, generates excessive abuse complaints, or violates these Terms or applicable law.
</p>
<h2>Payments & Billing</h2>
<ul>
<li>Invoices are issued <strong>14 days</strong> before the renewal date unless otherwise stated.</li>
<li>Payments must be made on time to avoid service suspension.</li>
<li>A <strong>10%</strong> late fee may be applied to overdue invoices.</li>
<li>Services may be suspended for non-payment.</li>
<li>
If an invoice remains unpaid for <strong>seven (7) days</strong>, the associated service may be deleted and data
may not be recoverable.
</li>
<li>
If a backup is available and a customer requests restoration, a
<strong>£25 restoration fee</strong> may apply.
</li>
<li>It is the customer's responsibility to ensure valid payment methods and current billing information are maintained.</li>

<h2>Service-Specific Terms</h2>
<p>
Additional service-specific terms may apply depending on the product or service purchased. These may include, but are
not limited to, hosting services, virtual servers, dedicated servers, domain names, managed services, and one-time fee products.
Where such additional terms apply, they form part of these Terms of Service.
</p>
<h2>Identity Verification & Abuse Prevention</h2>
<p>
To protect our network, upstream providers, platform integrity, and customers, xHosts UK reserves the right to request
identity verification or additional information at any time, including after service activation.
</p>
<p>
Identity verification may be required in response to suspected abuse, fraud, policy violations, security concerns,
elevated risk indicators, or increased abuse trends affecting specific services or product lines, including one-time fee hosting accounts.
</p>
<p>
Identity verification may be conducted through a trusted third-party provider, including Stripe Identity. xHosts UK
does not receive, store, or process identity documents directly and only receives verification status and reference identifiers.
</p>
<p>
Failure or refusal to complete requested verification within a reasonable timeframe may result in service suspension
or termination, without refund, in accordance with these Terms of Service.
</p>
<h2>Limitation of Liability</h2>
<p>
xHosts UK provides services on an <strong>"as is"</strong> and <strong>"as available"</strong> basis. To the fullest extent
permitted by law, we make no warranties, express or implied, including but not limited to warranties of merchantability,
fitness for a particular purpose, and non-infringement.
</p>
<p>
xHosts UK shall not be liable for any indirect, incidental, special, consequential, or economic loss, including but not
limited to loss of profits, revenue, business, data, goodwill, or opportunity arising from the use of, inability to use,
or interruption of our services, even if we have been advised of the possibility of such losses.
</p>
<p>
In all cases, our total liability shall not exceed the amount paid by the customer for the affected service during the
<strong>three (3) months</strong> immediately preceding the event giving rise to the claim.
</p>
<h2>Network & Infrastructure</h2>
<p>
We reserve the right to suspend, restrict, reroute, null-route, filter, or terminate any service or traffic where required
to protect our network, upstream providers, other customers, or infrastructure. This includes action taken in response to
abuse complaints, DDoS attacks, security threats, excessive resource usage, legal requests, or emergency maintenance.
</p>
<p>
We do not guarantee uninterrupted service, continuous availability, or immunity from attacks, outages, hardware failure,
third-party issues, upstream provider incidents, routing problems, or force majeure events.
</p>
<h2>Customer Responsibility</h2>
<p>
Customers are responsible for maintaining the security of their services, software, passwords, applications, and stored data.
This includes keeping systems up to date, using strong passwords, securing control panels, and promptly responding to any
abuse or security notices sent by us.
</p>
<p>
The customer is responsible for all activity conducted through their account or services, whether authorized by them or not,
unless caused solely by our proven negligence.
</p>
<h2>Domain Names</h2>
<p>
Domain name services are subject to availability, registry rules, and registrar policies. Domain registrations, transfers,
renewals, and restorations are generally non-refundable once processed. It is the customer's responsibility to ensure domain
names are renewed before expiry where renewal is desired.
</p>
<h2>Termination</h2>
<p>
We reserve the right to suspend or terminate any service, without prior notice, where we reasonably believe there has been
a breach of these Terms of Service, non-payment, abuse, unlawful activity, fraud, or conduct that places our systems,
providers, customers, or reputation at risk.
</p>
<p>
Upon termination, access to the affected service may be removed immediately and stored data may be deleted without further notice.
